Sutton Stracke is sorry for how she reacted to the news of Dorit Kemsley’s home invasion while filming the new season of “The Real Housewives of Beverly Hills.”

“I had a weird day and so I wasn’t focused and I was insensitive to what happened,” Stracke, 50, exclusively tells Page Six.

“Once I kind of got my brain settled and understood the severity, I think contrite can only explain how I felt.”

Bravo released a preview to People magazine Tuesday that shows Kyle Richards recapping Kemsley’s terror with Stracke, who appears apathetic when she states, “I’ve been putting out fires all day today, too.”

In the clip, Stracke expresses frustration over the trouble she’s had getting a French designer to California to help her complete a business-related project. “It’s all relative. I mean, I wasn’t held and gunpoint,” she tells Richards. “I’m sorry. It’s been a weird day, a weird morning.”

Richards, 53, shocked by Stracke’s remarks, then asks in a confessional, “Are you that wrapped up in yourself that you are not grasping what just happened to our friend?”

Kemsley, 45, was at her house in Encino, Calif., with her two young children on the evening of Oct. 27, 2021, when armed men broke in and stole high-end belongings including jewelry, handbags and watches.

“There was someone … who said, ‘Just kill her, just kill her already, just kill her,’ and all I could think of [was], ‘I have to save those babies.’ I begged them, I begged for my life, and begged for their life,” the Beverly Beach founder previously told “Access Hollywood,” recounting the horrifying incident.

Kemsley’s son, Jagger, 8, and daughter, Phoenix, 6, whom she shares with husband Paul “PK” Kemsley, were asleep at the time of the robbery, while PK, 54, was in London.

“I never would want anything bad to happen to Dorit or her family, ever,” Stracke asserts in her chat with Page Six. “None of us want anything bad to happen to any of us. That is the scariest thing and the environment that we live in, especially here in LA in Beverly Hills, it kind of set me off a little bit.”

The SUTTON boutique owner adds, “I just wasn’t there. I wasn’t being present. And so I think insensitive is the best word for [my reaction to the break-in]. And I was very sorry for it.”

The two women eventually forged a stronger friendship, though Stracke teases that it took some effort on her part.

“I think we’ll see how the show unfolds a lot of clarity — and we’ll just see how she reacts to me and if I can offer any help,” the cashmere designer says of her attempts to support Kemsley. “I call it [my] season of forgiveness.”

Stracke and Kemsley recently hung out at the Stagecoach country music festival with Richards and “The Middle” singer Maren Morris, proof that progress was made.

“I’ve loved getting to know her [and] I’ve loved getting to know PK more,” Stracke notes. “He’s very funny. And her children, I could eat them up. The idea of anything happening to them is awful.”

Superior Court Judge Found He Lacked Credibility in Denying Having Promised the Lessee of Premises That He Would Cause Power to Be Restored to Fire-Damaged Building; Manella Sees No Error

A non-practicing lawyer with a disciplinary record who leased a fire-damaged unit to a woman upon the promise he would restore power to it, but failed to do so, then disclaimed ever having made the commitment, must pay the former tenant nearly $40,000 in attorney fees, in addition to damages, under an opinion of this district’s Court of Appeal, filed yesterday.

Presiding Justice Nora M. Manella of Div. Four authored the opinion, which was not certified for publication. It affirms a judgment by Los Angeles Superior Court Judge Wendy Chang in favor of the ex-tenant, Connie Hernandez.

Hernandez sued after repudiating the lease. Months had passed since she leased the premises in Pearblossom, an unincorporated area of the Antelope Valley, and power for the premises, which she had intended to use for a restaurant, had not been restored.

The lessor, Phoenix Thottam, a lawyer on active status who is in the real estate business, insisted that he had never promised to reinstate electricity, though the Craigslist ad to which Hernandez responded said that the lessor was “in the process of restoring power.”

Chang’s Decision

Chang said in her decision, following a bench trial:

“The court… finds that Defendant’s denials of his assurances of restoring power by August 2018 to lack credibility.”

Thottam claimed that the intended purpose of the space being leased was for storage, but Chang said: “The court finds Defendant’s assertion that the Lease was not for a restaurant, but rather, for storage, to lack credibility and in contravention of the terms of the Lease itself. The Lease, drafted by Defendant, asserts that it is for the purpose of a Mexican seafood restaurant.”

The judge determined that “Defendant did not lack good faith in attempting to make repairs—what he lacked were funds.”

Attorney Fees

She awarded damages in the amount of $13,200, costs totaling $2,895.70, and ruled that attorney fees were due because Thottam had inserted a provision in the lease that he would be entitled to such fees if he prevailed in litigation and, under Civil Code §1717, Hernandez would necessarily have a like entitlement if she won. Chang later set the fees at $39,790.

In her opinion affirming the judgment, Manella rejected Thottam’s contention that Chang violated the parol evidence rule by considering extrinsic evidence as to a promise to restore power when the lease, itself, said the premises were being let “as is.”

She wrote:

“The trial court correctly concluded that the lease was ambiguous as to appellant’s obligation to restore power to the unit. On one hand, the lease repeated several times that the unit was provided on an ‘as is’ basis and that respondent would be responsible for all necessary repairs. On the other hand, the lease repeatedly referenced appellant’s work to restore power to the unit:…These provisions, which tied appellant to the task of restoring power to the unit, appear to depart from the “as is” provisions, which generally laid responsibility for all repairs on respondent.”

Resolving Ambiguity

There was no error in resolving that ambiguity against Thottam, she said, and no error in construing against him an ambiguity as to attorney fees. Manella noted Chang’s reliance upon the fact that it was Thottam who drafted the lease, and said:

“[T]he trial court’s reasoning was correct.”

The case is Hernandez v. Thottam, B306547.

Thottam was suspended from law practice from Oct. 31, 2008 to Jan. 29, 2009 based on an Aug. 26, 2004 conviction for petty theft.

More than 1,000 American Academy of Cosmetic Dentistry (AACD) members, dental professionals, students, sponsors, and exhibitors attended the 38th Annual AACD Scientific Session in Orlando, April 27-30, 2022.

After two annual events were cancelled due to the pandemic, AACD came back stronger than ever kicking things off with a blowout welcome reception, Wonderland: We’re All Mad Here. Then, innovative esthetic education and hands-on workshops took center stage.

AACD 2022 delivered an exceptional continuing education experience for dental professionals who are passionate about pursuing excellence in the art and science of cosmetic dentistry and those committed to begin their AACD Accreditation journey—the only advanced credential in cosmetic dentistry.

The conference concluded with the memorable Celebration of Excellence gala event, Bring Back the Magic, honoring AACD’s newly Accredited and Accredited Fellow members. In 2022, three Accreditation classes took to the stage since previous conference cancellations caused them to have to wait for this unforgettable honor and peer recognition.

The Academy also welcomed its new President, Marilyn Calvo, DDS, AAACD. An AACD Accredited Member, Dr. Calvo is a 1979 graduate of the University of California at Los Angeles School of Dentistry. She has been in private practice in Encino, California, since 1980 where she focuses on cosmetic restorative dentistry.

Through its charity auction and fundraising event at TopGolf Orlando, the AACD Charitable Foundation raised more than $50,000 for its Give Back a Smile program! Give Back a Smile restores damaged smiles of adult survivors of domestic and sexual violence. The Charitable Foundation’s incoming volunteer leaders also took office.

Dwight G. Rickert, CDT, FAACD, and Les Latner, DDS, AAACD, were reappointed to each serve three-year terms on the Board of Trustees and Alexandra H. Arnold, DMD was appointed for a one-year Associate Member term. Dwight G. Rickert, CDT, FAACD will serve as Chair for the upcoming year.

The Academy is already looking forward to AACD 2023 Texas, which is scheduled for April 26-29 at the Gaylord Texan in Grapevine.

UFCW Local 770 approves contract with Gelson’s

Grocery store associates represented by six United Food and Commercial Workers locals in Southern and Central California voted “overwhelmingly” to ratify a new labor contract with Gelson’s Markets, UFCW Local 770 reported.

Under the new agreement, most workers will receive wage hikes of $4.25 per hour over the three-year contract, and some classifications will get higher pay raises, Los Angeles-based UFCW 770 said late Friday following the vote tally. The pact also guarantees a minimum of 28 hours a week for eligible part-time employees and cuts the time required to advance in the wage scale, which means that more workers will receive their benefits sooner, the union noted. That change also will lead to “significant increases” in take-home pay, as much as $3,000 annually for some employees, according to UFCW 770.

The contract covers more than 2,000 supermarket employees represented by UFCW Locals 135, 324,

770, 1167, 1428 and 1442, spanning market areas from Paso Robles in Central California to the U.S.-Mexico border.

Overall, Encino, Calif.-based Gelson’s operates 27 upscale supermarkets from Santa Barbara to San Diego, mostly along the Southern California coast and in the Los Angeles area but also with one location in Rancho Mirage, near Palm Springs.

“This historic contract gives power back to the employees and lays the foundation for future great contracts for workers. It provides the highest wage gains employees have seen in their careers, and we were able to close the gap between food and GM rates,” bargaining committee member Matthew Plotkin, a bookkeeper at a Gelson’s store in Encino, said in a statement.

UFCW 770 noted that the new labor deal with Gelson’s also improves dental and vision plans, safeguards pension benefits and adds new safety language to ensure employees are part of health and safety committees at all stores. The union said the latter provision ensures store associates will be able to make safety decisions to protect workers and customers.

“I am excited about this contract. The raise in wages, reducing the number of hours employees need to reach the next tier increasing their pay, and the change of language in the contract benefits us. With this contract, employees will be able to enjoy financial stability,” commented bargaining committee member Lawrence Martinez, a service deli clerk at Gelson’s store in West Hollywood. “My co-workers deserve this great contract. Their stellar personal customer service, being knowledgeable and helpful employees, always providing good quality products, makes it so convenient for customers so they don’t have to go shopping anywhere else. Our daily work builds the Gelson’s brand that differentiates us from the rest.”

UFCW 770’s contract ratification with Gelson’s continued a flurry of approvals in California. Last week, UFCW Local 8-Golden State has ratified new labor agreements for supermarket workers at Safeway and Vons (Albertsons Cos.) and Save Mart, Lucky and Food Maxx (The Save Mart Cos.) stores in Northern and Central California. The new collective bargaining agreements cover more than 15,500 members of UFCW 8GS as well as members of UFCW Local 5 in the San Francisco Bay Area and Local 648 in San Francisco.

Southern California members of UFCW 8GS also approved contracts with Food Maxx, Save Mart, Stater Bros. and Albertsons/Vons/Pavilions. The union said talks were ongoing between UFCW 8GS and Raley’s/Nob Hill and Bel Air stores in Northern California.

Roseville, Calif.-based UFCW 8GS, too, was one of seven UFCW locals in California — also including UFCW 135, 324, 770, 1167, 1428 and 1442 — on April 14 to ratify three-year contracts with Ralphs (The Kroger Co.), Albertsons, Vons and Pavilions after reaching a tentative deal on April 4. The initial deal averted a strike, which had been authorized a week earlier. More than 47,000 workers are covered under the new agreement. UFCW 8GS, 135, 324, 770, 1167 and 1428 also approved a new contract with Stater Bros. on April 9.

“It was time to improve our pay and win a substantial contract,” according to Chad Harris, a food clerk at Gelson’s store in the Silver Lake neighborhood of Los Angeles and a UFCW 770 bargaining committee member.

“I’m very glad that all classifications are getting a pay raise in this contract,” Harris stated. “Employees are going to be able to afford basic necessities such as paying for gas and buying food.”
